Domain Trasnfer Policy

This Domain Transfer Policy (“Policy”) governs the transfer, handover, and technical delivery of domain names purchased through LuxyNames, a brand operated by The Complete Studio, which conducts business under the name LuxyNames (“The Complete Studio”, “LuxyNames”, “we”, “us”, or “our”).

By purchasing a domain name from LuxyNames, you (“Buyer”, “you”) agree to the terms outlined in this Policy.

 

1. Scope of This Policy

This Policy applies to:

  • All domain names purchased through LuxyNames
  • Transfers conducted with or without third-party escrow services
  • Transfers involving registrars, registries, or domain service providers

 

This Policy should be read together with the:

 

2. Ownership Transfer vs Technical Transfer

2.1 Ownership Transfer

Ownership of a domain name is considered commercially transferred to the Buyer once:

  • Full payment has been received and confirmed, and
  • Any agreed escrow conditions have been satisfied

From this point onward, the Buyer assumes all responsibility for the domain name.

 

2.2 Technical Transfer

Technical transfer refers to:

  • Registrar-to-registrar transfer
  • Account-to-account push
  • Change of registrant details (where applicable)

 

Technical transfer timelines may vary due to:

  • Registry rules
  • Registrar policies
  • Mandatory holding or lock periods
  • Security or verification requirements

 

3. Minimum Holding & Lock Periods

Certain domains may be subject to mandatory holding or lock-in periods, including but not limited to:

  • Newly registered domains
  • Recently renewed domains
  • Domains with recent ownership changes

 

Important Clarification:

  • Such restrictions are imposed by registrars or registries, not by LuxyNames
  • These restrictions do not delay ownership transfer
  • Buyers may use the domain immediately via DNS or nameserver changes

 

4. Day-One Usage & DNS Control

Upon completion of purchase:

  • Buyers may request immediate changes to:
    • Nameservers
    • DNS records
  • LuxyNames provides assistance via its Post-Purchase Assistance process.

 

This allows Buyers to:

  • Connect hosting services
  • Launch websites or landing pages
  • Configure email services

 

Such assistance is provided solely to facilitate usage and does not imply ongoing technical support obligations.

 

5. Transfer Methods

Depending on the domain and registrar, transfer may occur via:

  • Internal account push
  • Authorization (EPP) code transfer
  • Change of registrant details
  • Escrow-mediated handover

 

The specific method will be determined by:

  • Registrar capabilities
  • Buyer preference
  • Security considerations

 

6. Escrow-Facilitated Transfers

Buyers may choose to use a third-party escrow service for secure payment and transfer coordination.

Key points:

  • Escrow services operate independently of LuxyNames
  • LuxyNames does not control escrow timelines or decisions
  • Any escrow fees are borne by the Buyer unless agreed otherwise

 

LuxyNames will cooperate in good faith with escrow procedures but shall not be held responsible for delays or outcomes caused by escrow providers.

 

7. Buyer Cooperation & Responsiveness

Timely completion of a domain transfer requires Buyer cooperation.

The Buyer agrees to:

  • Provide accurate registrar account details
  • Respond promptly to verification emails or requests
  • Follow registrar or escrow instructions

 

Delays caused by Buyer inaction or incorrect information are not the responsibility of LuxyNames.

 

8. Transfer Timelines

While LuxyNames aims to complete transfers promptly:

  • Transfer timelines are not guaranteed
  • Typical timelines may range from a few hours to several days or weeks
  • External factors may extend timelines beyond LuxyNames’ control

 

No delays shall constitute grounds for cancellation, refund, or dispute where LuxyNames has acted in good faith.

 

9. Risk Transfer & Responsibility

Once ownership has been transferred:

  • All risks associated with the domain pass to the Buyer
  • The Buyer is responsible for renewals, usage, compliance, and security
  • LuxyNames is not responsible for loss, suspension, or misuse after transfer

 

10. Failed or Reversed Transfers

In rare cases, transfers may fail due to:

  • Registrar restrictions
  • Buyer account limitations
  • Escrow issues
  • Regulatory or registry actions

 

LuxyNames will make reasonable efforts to resolve such issues but does not guarantee resolution where third-party systems are involved.

 

11. Limitation of Liability

To the fullest extent permitted by law:

  • LuxyNames shall not be liable for indirect, incidental, or consequential damages
  • Liability, if any, shall not exceed the amount paid for the domain
  • LuxyNames is not liable for actions or omissions of registrars, registries, or escrow providers

 

12. Indemnification

The Buyer agrees to indemnify and hold harmless The Complete Studio, its owners, team members, and affiliates from claims arising from:

  • Use or misuse of the domain
  • Transfer-related disputes
  • Regulatory or legal actions after transfer

 

13. Dispute Resolution

Any disputes related to domain transfers shall first be addressed through good-faith discussions.

If unresolved, The Complete Studio reserves the right to determine the appropriate dispute resolution mechanism or jurisdiction.

 

14. Policy Updates

This Policy may be updated at any time. Continued use of LuxyNames services constitutes acceptance of the revised version.
